These Terms of Use ("Terms") govern your use of the Talk2Memo application and services ("Service") provided by Bissano Software ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using Talk2Memo, you confirm that you are at least 17 years of age and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Description of Service
Talk2Memo is an AI-powered voice transcription service that allows you to record audio, generate transcripts, create AI summaries, and search your recordings. The Service uses third-party AI providers including AssemblyAI for transcription and OpenAI for AI summaries and chat features.
3. Third-Party AI Services and Data Sharing
To provide transcription and AI features, the Service transmits your data to the following third-party providers:
• AssemblyAI — Your audio recordings are transmitted to AssemblyAI for speech-to-text transcription. AssemblyAI processes audio solely to generate transcripts and does not retain audio beyond the processing period. See AssemblyAI's privacy policy at assemblyai.com/legal/privacy-policy.
• OpenAI — Your transcript text is transmitted to OpenAI to generate AI summaries and to power the AI chat feature. OpenAI processes text in accordance with its API usage policies. See OpenAI's privacy policy at openai.com/policies/privacy-policy.
By using Talk2Memo's transcription and AI features, you consent to your audio and transcript data being transmitted to these providers for processing. You should not record conversations containing sensitive personal information unless you are comfortable with this data being processed by these third parties.
4. Subscriptions and Billing
Talk2Memo offers auto-renewable subscription plans (Personal, Pro, and Business). Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
• iOS App Store: Subscriptions purchased through the App Store are managed by Apple. To cancel, go to Settings → [Your Name] → Subscriptions on your iPhone.
• Google Play: Subscriptions purchased through Google Play are managed by Google. To cancel, go to Google Play → Subscriptions.
• Web (Stripe): Subscriptions purchased on the website are managed by Stripe. You can cancel through the subscription management portal in your Profile settings.
No refunds are provided for partial subscription periods. Free plan users receive 200 minutes of transcription per month at no charge.
5. User Content
You retain ownership of all recordings and transcripts you create. By using the Service, you grant us a limited licence to store and process your content solely to provide the Service. We do not use your content to train AI models.
6. Acceptable Use
You agree not to use the Service to record conversations without the consent of all participants where required by law, to record or transcribe illegal content, or to attempt to circumvent the Service's technical measures.
7. Data Retention and Deletion
Audio files are automatically deleted from our servers 30 days after recording. Transcripts are retained until you delete them or delete your account. You may delete your account and all associated data at any time through the Profile settings.
8. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind. We do not guarantee the accuracy of AI-generated transcripts or summaries. Transcription accuracy depends on audio quality, language, and background noise.
9. Limitation of Liability
To the maximum extent permitted by law, Bissano Software shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.
10. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
